Un tema que se presentó en esta semana fue la Evaluación del Desempeño Legislativo, que realizó el Comité Evaluador; dicho trabajo es parte de un ejercicio que fue aprobado por la Comisión de Régimen Interno y Concertación Política, más conocida como CRICP.
En el documento que se presentó ante los diferentes medios de comunión se desglosan los indicadores de evaluación como son: 1).- Calidad de Procesos Legislativos, 2).- Desempeño Básico del Legislador y 3).- Calidad de la Información del Legislador.
En términos globales el vocero del Comité Evaluador, maestro Aquiles Fuentes mencionó que los diputados de la LXI Legislatura estaban entre el 6 y 7 de calificación y a lo que agregó, que en este primer años los legisladores habían pasado de “panzazo”.
La Primera recomendación del Comité Evaluador fue: que las iniciativas sean en estricto apego a las reglas y normas que dicta la metodología moderna en cuanta a la calidad de la información; y por otra parte, se observó una falta de vinculación social que esta pendiente por parte de los diputados.
Segunda recomendación: que el Congreso del Estado actualice el código de conducta de acuerdo al conjunto de reformas que se han aprobado en cuanto a transparencia, inclusión social y el funcionamiento interno del poder legislativo, transformando dicho código de conducta en un código de ética.
Tercera recomendación en referencia al indicador no.2: que se haga una propuesta de un nuevo ordenamiento que contemple todos los aspectos importantes a evaluar, en cuanto a la conducta que debe de mostrar la legisladora o legislador y, lo que se espera de ellos y ellas de acuerdo a la importancia de su investidura.
De lo anterior, el Comité Evaluador considera que los lineamientos actuales son insuficientes para realizar una “evaluación completa”.
En cuanto a la agenda temática, se estima que sería prudente definir algún protocolo para que el reciente creado instituto de investigaciones sugiera a la CRICP y a los diputados temáticas que requieran algún tipo de actualización legislativa, pues el Comité Evaluador considera relevante revisar y acordar los temas que habrían de legislarse y sopesar para evitar, en la medida de lo posible, sobreabundar temas y en su caso discriminar otros que son relevantes para la vida de un Estado o municipio.
¿Qué dicen los números?
Dentro de las iniciativas presentadas por grupo parlamentario vemos que el PAN (integrado formalmente por 13 diputados) presentó un total de 14 iniciativas, contra 6 de Nueva Alianza (integrado por 2 diputados) y 2 iniciativas del PRI (integrado por 15 diputados).
En cuanto a los legisladores que no presentaron Iniciativas de Ley en el primer año de trabajo fueron: Angelica María Payan y Lina Acosta Cid de PAN; Teresa María Olivares Ochoa de Nueva Alianza y los diputados del PRI, Omar Alberto Guillén Partida, Brenda Elizabeth Jaime Montoya, Rafael Buelna Clark, Karmen Aida Díaz Brown, Ana María Luisa Valdés Avilés y Rodrigo AcuñaArredondo.
Los diputados y diputadas con “experiencia legislativa”, y/o quienes ya estuvieron en anteriores legislaturas son: Flor Ayala Robles Linares del PRI, quien presentó 2 Iniciativas de Ley; Javier Villarreal Gámez del PRI, presentó 1 Iniciativa de Ley; Luis Serrato Castell del PAN, presentó 1 Iniciativa de Ley y las Diputadas Angelica María Payan y Lina Acosta Cid de PAN no presentaron ninguna iniciativa.
Los temas de las iniciativas analizadas por los legisladores de Sonora se enfocaron en gobernabilidad, estabilidad y paz social, justicia, seguridad, política, anticorrupción, transparencia , derechos humanos, genero, igualdad, grupos vulnerables, Régimen Interno del Congreso y en menor medida, en economía, finanzas públicas, infraestructura y sustentabilidad.
En un anterior ejercicio realizado por VORTICE, en otros indicadores se publicó el gasto en viáticos en los primeros 9 meses de trabajo legislativo de cada fraccion parlamentaria, obteniendo los siguientes resultados: PAN obtuvo 650,000.00 pesos por viáticos; el PRI 618,500.00 pesos; Nueva Alianza 137,500.00 pesos; el PRD 54,000.00 pesos; Movimiento Ciudadano 51,500.00 pesos y MORENA 13,500.00 pesos.
Es así como el primer Informe de Evaluación del Desempeño Legislativo es un ejercicio que se agradece, pues de alguna forma también se puede comparar la labor de cada diputado con el gasto que realiza y así comparar la productividad con el costo y gastos que realiza cada legislador.
En este primer informe se encuentra en un primer plano la actividad de los 33 diputados locales durante un año, y el objetivo es eficientar la labor en el Congreso del Estado en busca de mantener un aparato legislativo que sea funcional para los ciudadanos ahí representados.
