Joaquín «el Chapo» Guzmán no está nada feliz con las condiciones de su encierro en Nueva York.
La defensa del narcotraficante mexicano protesta por la situación que vive tras su extradición, en su segunda aparición ante una corte de Estados Unidos.
La fama de narco poderoso y evasor de prisiones le pasa factura en Nueva York, donde sus abogados reclaman que en la cárcel le han negado recibir desde su esposa hasta un vaso de agua.
Guzmán apareció este viernes ante un juez de Brooklyn por segunda vez desde que fue extraditado a Estados Unidos el 19 de enero, e intercambió miradas con su mujer Emma Coronel, que viajó desde México para asistir a la audiencia.
Pero la defensa no consiguió que el juez acogiera un pedido para que Guzmán pueda ver a Coronel en su prisión de máxima seguridad en Manhattan, o tenga más acceso a abogados.
Acusado de liderar una gigantesca organización criminal de Sinaloa que introdujo toneladas de drogas a EE.UU. mediante violencia, secuestros y asesinatos, el mexicano de 59 años se ha declarado inocente pero podría recibir a cadena perpetua si un gran jurado lo encuentra culpable.
El juez Brian Cogan pareció aludir a las dos fugas que Guzmán protagonizó de prisiones mexicanas para dejar en manos de las autoridades carcelarias la decisión sobre sus condiciones de encierro en Nueva York.
«Hay motivos para tomar medidas extra de seguridad», advirtió.
Y es que Guzmán protagonizó dos fugas de película en México. La última, de una cárcel de máxima seguridad a través de un túnel.
«Muy difícil»
El narcotraficante volvió a aparecer en la corte con un traje de presidiario azul oscuro, sin estar esposado, y durante la audiencia permaneció en silencio escuchando a un traductor a su lado.
Coronel, una exreina de la belleza 32 años más joven que su marido, vestía jeans, chaqueta negra y un pañuelo amarillo en el cuello. Se sentó en las primeras filas del público, a pocos metros de Guzmán.
La situación fue «muy difícil» para Coronel, aseguró a su lado la abogada de oficio de Guzmán, Michelle Gelernt, durante una breve conferencia de prensa al salir de la corte.
«Es la primera vez que lo ve desde que fue traído a Estados Unidos y hasta ahora la única forma que se le permite verlo», indicó.
Gelernt sostuvo que las condiciones de reclusión de Guzmán son «extremamente restrictivas» y deberían flexibilizarse porque el detenido ha tenido buen comportamiento en Estados Unidos.
«Está encerrado en una celda 23 horas al día y sólo le permiten hablar con limitados miembros de nuestra oficina y una hora de ejercicio al día», sostuvo.
La abogada rechazó que eso se justifique por los antecedentes de fugas carcelarias de Guzmán en México, indicando que los carceleros llegaron a negarle agua durante un encuentro con su defensa.
«No creo que se piense que si hago que los guardias le den un vaso de agua durante una reunión de tres horas, eso de algún modo va a lograr su fuga», comentó.
¿Conflicto de interés?
La defensa también indicó que Guzmán está «muy preocupado» sobre la legalidad de su extradición.
Gelernt dijo que «los cargos aquí en el distrito este de Nueva York nunca fueron objeto de los procedimientos de extradición en México».
Las autoridades estadounidenses sostienen que el gobierno mexicano aceptó en un documento que Guzmán fuera juzgado en ese distrito, pero Gelernt afirmó que no ha podido acceder ese documento sin que obliguen a su defendido a firmarlo.
El juez ordenó que los papeles públicos de la extradición sean entregados a la defensa.
Guzmán recibió abogados de oficio, que suelen defender a reos sin recurso para costearse un letrado, porque su extradición fue sorpresiva y no contaba con representante legal en Nueva York.
La fiscalía ha señalado que existe un potencial conflicto de interés con esa defensa de oficio, ya que podría haber tenido vínculos en el pasado con algunos de los testigos que tendrá el juicio, cuyas identidades se desconocen.
El juez nombró a un abogado privado para que explique esto a Guzmán en la cárcel.
Pero los defensores descartaron que haya tal conflicto de interés y señalaron que las condiciones de reclusión de Guzmán le imposibilitan elegir a otro defensor.
«Si quieren que acceda a contratar un abogado, creemos que tiene que ser capaz de encontrarse con su familia o hablar con su familia», indicó Michael Schneider, otro abogado de oficio de Guzmán.
Sin embargo, el juez Cogan cuestionó ese argumento y marcó la próxima audiencia para dentro de 90 días, a comienzos de mayo, sin que haya fecha aun para el inicio del juicio.
