Multas a los partidos políticos ascienden a más de un millón 300 mil pesos
El Consejo General del Instituto Nacional Electoral (INE) aprobó 11 proyectos de resolución de Procedimientos Ordinarios Sancionadores (POS), iniciados en contra de diversos partidos por la presunta transgresión a la libre afiliación, uso indebido de datos personales y nombramientos irregulares como representantes de Mesas Directivas de Casilla, durante los procesos electorales federal y locales de 2015 y 2017.
En su presentación, la presidenta de la Comisión de Quejas y Denuncias, Claudia Zavala Pérez, indicó que los partidos multados y sancionados no justificaron, ni aportaron elementos probatorios suficientes que permitieran suponer que la “acreditación” de las personas como representantes, se llevó a cabo con su consentimiento, libre y voluntario.
También señaló que, particularmente, en el procedimiento identificado con el número de expediente 85/2019 se tiene demostrado que el Partido de la Revolución Democrática actuó dolosamente al presentar algunas cédulas de afiliación, cuyas firmas no corresponden a las de las personas denunciantes.
En sesión extraordinaria, el Consejo General determinó imponer sanciones y multas a los partidos Acción Nacional (PAN), Revolucionario Institucional (PRI), de la Revolución Democrática (PRD), del Trabajo (PT) y Verde Ecologista de México (PVEM), las cuales ascienden a más de un millón 300 mil pesos, derivado de diversas infracciones a la legislación electoral en cuanto al derecho de nombrar representantes ante Mesas Directivas de Casilla y la protección de datos personales.
Por violaciones consistentes en el indebido registro de nombramientos como representantes de casilla durante el Proceso Electoral Federal 2014-2015 y el proceso local 2014-2015 en el Estado de México, así como por afiliaciones indebidas, los integrantes del Consejo General determinaron imponer multas al PRDpor 138 mil 471 pesos, así como una amonestación pública, ya que del análisis preliminar de los asuntos, las cédulas de afiliación otorgadas por este partido tienen inconsistencias en las fechas de registro proporcionadas por la Dirección Ejecutiva de Prerrogativas y Partidos Políticos (DPPP) del INE.
En cuanto a los nombramientos de representantes de casilla, no se desprenden firmas en el apartado nombre y firma del representante acreditado, aunado a que en las Actas de la Jornada Electoral y de Escrutinio y Cómputo de los procesos electorales mencionados, no se localizó constancia de la presencia de los ciudadanos, mientras que los argumentos de defensa del PRD carecieron de sustento probatorio.
Por otro lado, el Consejo General impuso al PAN 12 multas que ascienden a más de 550 mil pesos, en razón de la indebida acreditación de ciudadanos durante los procesos electorales locales 2016-2017 en el Estado de México, Ordinario Local 2015-2016 en Oaxaca y 2015-2016 en Chihuahua.
En el mismo sentido, el PVEM y el PT se hicieron acreedores a una multa de poco más de 45 mil pesos, respectivamente. Finalmente, al PRI se le adjudicaron dos multas que en total ascienden a más de 90 mil pesos.
En cuanto a las violaciones a la normativa electoral, consistentes en el derecho de libre afiliación y uso no autorizado de datos personales, se impusieron amonestaciones públicas en tres proyectos, dos de ellos en contra del PRD y uno en contra del PT.
Durante la misma sesión, se resolvió imponer una multa al partido Morena equivalente a 80 mil 600 pesos, por incumplir con la resolución del Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales, del 5 de septiembre de 2018, identificada con el expediente DIT 0188/2018.
Resuelven proyectos sobre remoción de consejeros electorales
En la misma sesión se resolvieron dos proyectos de remoción de consejeros electorales de los Organismos Públicos Locales Electorales (OPLE) de Puebla y Tlaxcala, respectivamente.
En el caso de Puebla, el Consejo General aprobó por mayoría de 9 votos, desechar el procedimiento y dar vista a la Contraloría Interna del Instituto Electoral del Estado, para que esa autoridad sea quien determine la responsabilidad de los actos denunciados contra los consejeros electorales.
Lo anterior, ya que de un análisis preliminar, se advierte que las conductas denunciadas no constituyen alguna de las faltas graves previstas en el Reglamento de remoción.
En el caso de Tlaxcala se desechó la denuncia presentada por diversos integrantes de la Comunidad Nahua de Guadalupe Ixcotla, Municipio de Chiautempan, en contra de Integrantes del Consejo General del Instituto Tlaxcalteca de Elecciones, por actualizarse diversas causas de improcedencia entre las que destaca, que las conductas denunciadas derivan de un criterio de interpretación jurídica.
