Iniciativas para ampliar el plazo para recibir el acta de defunción a fin de facilitar los trámites a los deudos, y para establecer agravantes cuando se emplee la violencia en el delito de despojo cometido por dos o más personas, fueron presentadas, respectivamente, por los diputados Emeterio Ochoa Bazúa y Carlos Alberto León García.
HERMOSILLO, Son.- En sesión ordinaria de la Diputación Permanente, el diputado Ochoa Bazúa dio lectura a un proyecto de decreto que reforma el Artículo 105 de la Ley del Registro Civil para el Estado de Sonora, el cual se turnó para estudio a la Comisión de Gobernación y Puntos Constitucionales.
Expuso que en ciertas ocasiones, los trámites relacionados con la expedición de actas de defunción se complican o retrasan por el vencimiento del plazo de cinco días que establece dicha disposición, lo que ocasiona diversos problemas a los deudos, tales como la pérdida de tiempo, el incremento en los costos y el exceso de trámites burocráticos para obtener el acta de defunción.
“Muchas de las defunciones ocurren en lugares poco habitados y muy distantes de alguna oficina del Registro Civil. En otras ocasiones, tales como el descuido o el mismo desconocimiento de la Ley, no le permiten al interesado realizar el trámite de manera oportuna”, aseveró el Presidente de la Diputación Permanente.
Para evitar esta situación, señaló, la iniciativa que presenta propone ampliar el plazo de cinco a 15 días, para que la parte interesada pueda estar en mejores posibilidades de continuar y culminar con la expedición del acta de defunción.
“Al ampliar el plazo, los deudos se evitan tener que acudir a un Juzgado para realizar el trámite correspondiente, tener que contratar abogados o asesores legales que los orienten en este trámite y, finalmente, se evitan importantes periodos de tiempo en los trámites ante los juzgados”, expresó Ochoa Bazúa.
La Comisión de Justicia y Derechos Humanos estudiará por su parte la iniciativa presentada por el diputado Carlos Alberto León García, que tiene por objeto establecer agravantes cuando se emplee la violencia y cuando el delito de despojo sea cometido por dos o más personas, y que la sanción no sea sólo para los autores materiales del ilícito, sino también contra los autores intelectuales.
Explicó que con este proyecto de reforma se busca darle una mayor claridad al delito de despojo, en cuanto a que dicha conducta se emplee o no con violencia, por el o los activos en su comisión, en atención de que un gran número de ilícitos de este tipo se cometen sin el uso de violencia y donde impera la impunidad contra los delincuentes al momento de aplicar la Ley por parte de las autoridades ministeriales y jurisdiccionales.
“Se considera que la presente propuesta de reforma penal no vulnera ningún derecho humano ni garantías constitucionales, sino al contrario, viene a reforzar las actualmente establecidas en dicho ordenamiento jurídico, al permitir una mayor seguridad jurídica al gobernado”, expresó León García.
El proyecto se realizó con acciones afirmativas a favor de grupos vulnerables que históricamente son los más afectados por este tipo de delitos, indicó, como las personas de la tercera edad, con discapacidad, la población indígena, además de contar con perspectiva de género para proteger a madres jefas de familia que sean despojadas de su patrimonio, como bien jurídico tutelado.
El diputado León García propuso que la pena establecida en el Artículo 323 del Código Penal, que es de uno a seis años y de 20 a 200 días multa, se modifique para quedar de 100 a 200 días multa.
En esta sesión ordinaria, la diputada Lisette López Godínez presentó una iniciativa con punto de Acuerdo para exhortar al titular de la Secretaría de Salud Pública y a los 72 ayuntamientos, para que fortalezcan o, en su caso, implementen en coordinación con las demás dependencias, entidades y gobiernos locales, las acciones necesarias para evitar la propagación del virus del dengue y demás enfermedades vectoriales, a raíz de las lluvias generadas en las últimas semanas.
Sostuvo que a pesar de que desde 2015 las cifras muestran una tendencia considerablemente a la baja, es necesario trabajar de manera coordinada con los diferentes niveles de gobierno para evitar que la enfermedad vuelva a cobrar víctimas.
“En el tema del combate del dengue vamos muy bien, hemos visto como con el transcurso de los años se puede decir que hemos controlado esta epidemiología, el punto es no soltarlo. Ante las lluvias que se han presentado es indispensable no bajar la guardia”, afirmó López Godínez.
De acuerdo a datos del Sistema Nacional de Alerta Epidemiológica, 2 mil 571 casos de dengue no grave fueron registrados en 2015, dijo, mientras que en lo que va del año se han presentado 43 casos, lo cual demuestra la tendencia a la baja en materia de propagación.
Agregó que a pesar de que las estadísticas muestran un panorama positivo respecto a otros años, esto no debe ser motivo para evitar reforzar las prácticas en materia de prevención, ya que actualmente no se cuenta con una vacuna que fortalezca los sistemas inmunológicos y sea a prueba de este virus. El Acuerdo se aprobó por unanimidad.
