El Presidente del Supremo Tribunal de Justicia detalló que, aun cuando el Poder Judicial es un ente independiente y un poder soberano, se aprecian estas modificaciones por tener un “efecto para mejores presupuestos de ingresos y egresos, para que ningún poder se imponga al otro, se protege todo, principalmente programas sociales y cuanto sea de beneficio para la ciudadanía”.
Detalló que el veto por parte de la titular del ejecutivo está en la constitución, es una atribución del Poder Ejecutivo, no sólo en Sonora sino en todos los estados del país, “está plasmado en la constitución, y por lo tanto, algo que se puede contemplar y ejercer”, puntualizó.
Gutiérrez Rodríguez abundó que “el veto equilibra la fusión entre el Poder Legislativo y el Poder Ejecutivo, recordemos que para hacer leyes y que éstas adquieran vigencia tienen que intervenir los dos poderes, no lo puede hacer uno sin el otro, van en conjunto, y ambos llevan algunas funciones en concreto”, manifestó el jurista.
También consideró que esto podrá ayudar en el ejercicio del trabajo legislativo, pus no habrá situaciones en las que un poder se imponga al otro, lo que terminará por ofrecer mejores leyes.
El presidente de la CEDH Pedro Gabriel González Avilés, aseguró que esas reformas de aprobarse permitirán a ese organismo mantenerse al margen de intereses políticos y avanzar en la profesionalización.
“Estas reformas darán certeza de un presupuesto adecuado para la operación y permitirán garantizar la autonomía y cumplimiento de de objetivos institucionales, pues a pesar de que no refieren directamente a las funciones y atribuciones de la comisión, sí tienen implicaciones favorables a áreas constitucionalmente autónomas”, aseguró.
Francisco Cuevas Saénz comisionado presidente del ISTAI, sostuvo por su parte que esas iniciativas atienden a los principios básicos de transparencia y garantizan a los ciudadanos el acceso a la información pública gubernamental.
El pleno del ISTAI, integrado por el comisionado presidente, la comisionada Arely López Navarro y el comisionado Andrés Miranda Guerrero, explicaron que de aprobarse el paquete de reformas constitucionales propuesta por los diputados en el Congreso local, se tendría participación de por lo menos dos Poderes en la elección de los comisionados de este organismo, favoreciendo así la transparencia al momento de la designación.
“Lo que observamos desde el ISTAI es que la reforma está apegada a tres principios básicos”, comentó el comisionado presidente en nombre del pleno del Instituto:
“Primero, se trata de una reforma que atiende a la libre configuración legislativa de los estados; cumple también con el principio de la participación de al menos dos Poderes en la elección de los comisionados de este Instituto; y, tercero y más importante, se refrenda la participación de la sociedad civil dentro de los procedimientos que deben llevarse a cabo para integrar a los posibles comisionados”, detalló Cuevas Sáenz.
