Con el objetivo de adoptar medidas preventivas, así como dotar de transparencia y certeza al proceso de liquidación de los partidos Nueva Alianza y Encuentro Social —que tienen la probabilidad de perder su registro nacional—, la Comisión de Fiscalización del Instituto Nacional Electoral (INE) procedió a la designación de sus respectivos interventores, mientras se resuelven en su caso, las impugnaciones de las elecciones ante el Tribunal Electoral del Poder Judicial de la Federación (TEPJF).
La Comisión, presidida por el Consejero Ciro Murayama, e integrada por las Consejeras Pamela San Martín, Adriana Favela, así como de los Consejeros Marco Antonio Baños y Benito Nacif, seleccionó a Ramón Ismael Trejo Bazúa y Gerardo Maldonado García, como los probables interventores para los partidos Encuentro Social y Nueva Alianza, respectivamente, en virtud de que se les tiene que consultar si aceptan la responsabilidad.
De acuerdo con la Ley General de Partidos Políticos, si de los cómputos de los Consejos Distritales se desprende que un partido político nacional no obtiene el porcentaje mínimo de votos para mantener su registro —el 3 por ciento—de la votación válida emitida en alguna de las elecciones federales ordinarias para Diputados, Senadores o Presidente de los Estados Unidos Mexicanos, la Comisión de Fiscalización deberá designar, de inmediato, a un interventor, quien será responsable del control y vigilancia directa del uso y destino de los recursos y bienes del partido político durante el periodo de prevención, informó el Consejero Ciro Murayama.
En este sentido, y al considerar que aún no están resueltas, en su caso, las impugnaciones relativas a las tres elecciones federales —prosiguió—, el TEPJF tiene hasta el 3 de agosto para resolver sobre las elecciones al Legislativo y, a más tardar el 31 de agosto, lo correspondiente a la elección presidencial, el proceso de liquidación de ambos partidos se encuentra en su primera etapa que se denomina “de prevención”.
Según el Reglamento de Fiscalización, el periodo de prevención abarca desde el anuncio de los resultados de los cómputos distritales y hasta que se emita la constancia formal de pérdida de registro, tiempo en el cual el interventor se hará responsable en la administración del patrimonio de los partidos políticos mencionados.
El Consejero Ciro Murayama aclaró que el Reglamento de Fiscalización prevé, en caso de que, como resultado de la resolución de los juicios de inconformidad, el partido político en estado de intervención llegara a alcanzar la votación mínima, podrá reanudar en forma habitual sus operaciones. En caso contrario, advirtió, se pasaría de la prevención a la intervención para su liquidación respectiva.
Como parte de este procedimiento legal, cabe señalar que la Comisión de Fiscalización aprobó en marzo pasado la lista de especialistas en concursos mercantiles que desempeñan funciones de conciliadores y síndicos, y que luego de una consulta se definió que 56 interventores cubren el perfil adecuado para realizar dicha tarea, de conformidad con los criterios de selección y actualización.
La lista de 56 especialistas se dividió entre los dos partidos, para que a cada uno le correspondieran 28 posibles interventores. Y de cada una de las mismas se eligió en primer lugar a Ramón Ismael Trejo Bazúa y Gerardo Maldonado García, a quienes se les consultará (en presencia de la Oficialía Electoral del INE) si desean aceptar el trabajo; en caso contrario, se contactará al siguiente interventor en orden de prelación y la Secretaría Técnica de la Comisión de Fiscalización informará a los integrantes del Consejo General del INE quienes fungirán como interventor de los partidos mencionados.
